Privacy and Ed Law 2-D

As a parent, you may be aware the New York State Education Department is making a stronger push to monitor the efficacy of school districts in meeting the mandates set forth by part 121 of Education Law 2-D. These actions are being taken by the state to ensure that student (and some teacher) data privacy is being regarded with the utmost security, both in-district and by any approved third parties.

This page contains the four mandatory items that should be hosted on the district’s website, in addition to four elements that, while not required by the law, are recommended to include for the benefit of the public. To view any of these elements, please click on the respective link(s) below.

Annual Professional Performance Review (APPR)

The West Genesee Central School District’s APPR has been approved by the New York State Department of Education.  The APPR plan can be viewed by clicking here.

New York State law allows parents and legal guardians of a student to request the effectiveness scores and final ratings of teachers and principals to which the student is assigned for the current school year. Requests for this information have to be made in writing using the appropriate teacher or principal request form located at below on this page and sent to the following address:

This information may only be released to parents or legal guardians and the District will verify that any request received has been submitted by a parent or legal guardian. Additionally, the information is intended only for the use of the requesting parent or legal guardian.

Lead in Water Testing – 2020 Compliance

In an effort to comply with regulation 10 HYCRR 67-4 the district began testing all water outlets in February of 2020 that had potential for use by students and or staff for drinking or cooking. Samples were taken from all applicable outlets and sent to an approved independent third party laboratory for processing. Per the regulation, the allowable limit of lead concentration in water is 15 parts per billion (ppb). Any outlet tested that returned a result of 15ppb or greater was labeled and taken out of service for consumption until remediation and resting could take place.

To date all educational buildings have been tested and the results are listed below.

Parental Notification Required Under Federal Law

According to federal law, parents may request specific information as to the qualifications of their children’s classroom teacher(s) and teaching assistants. The following may be requested:

  • Whether the teacher has met State qualifications and licensing criteria for the grade level and subject area in which the teacher provides the instruction.

  • Whether the teacher is teaching under emergency or other provisional status through which state qualification or licensing criteria have been waived.

  • The baccalaureate degree major of the teacher and any other graduate certification or degree held by the teacher, and the field of discipline of the certification or degree.

  • Whether a child is provided services by teaching assistants, and, if so, their qualifications.

Professional Learning Plan July 1, 2022 – June 30, 2023

The purpose of the Professional Learning Plan July 1, 2022 – June 30, 2023 is to improve the quality of teaching and learning by ensuring all teachers and staff participate in substantial professional development in order that they remain current with their profession and meet the learning needs of their students. This plan also ensures that holders of Level III teaching assistant certificates and that substitute teachers who work on a long-term basis are provided the opportunity to participate in the professional development program of the district. Finally, this plan recognizes that all teachers, teaching assistants and staff need to participate in professional development to implement the best professional strategies to maximize student learning and success. In order to be appointed to positions by the Board of Education, professional staff must demonstrate proof of training in school violence prevention and intervention.

Title I Schools Information

The schools in the West Genesee Central School District that are eligible to received Title I federal funding for the upcoming year are:  Onondaga Road Elementary School, Split Rock Elementary School, and West Genesee Middle School. A requirement for each is to publish a Family Engagement Policy for each school, in addition to a District Parent Involvement Policy. Introducing the NYSED Parent Dashboard

The New York State Education Department (NYSED or the Department) has developed a Parent Dashboard to increase transparency and make information about school performance and other school-level data easier for parents and the public to access. The Parent Dashboard is now available in addition to the New York State School Report Card on the Department’s public data site. The Parent Dashboard offers information on all public schools including charter schools.

The Parent Dashboard is part of New York’s Every Student Succeeds Act (ESSA) plan, which emphasizes equity in education for all students and expands measures of school accountability and student success. In making the dashboard publicly accessible, NYSED aims to provide a resource that is truly valuable and will serve as a model for other states.

In 2019, NYSED gathered feedback from parents and stakeholders to guide the work of developing the Parent Dashboard. This year, NYSED is gathering additional feedback from parents and stakeholders to further guide enhancements to the Parent Dashboard. We invite parents and all other community stakeholders to explore the Parent Dashboard and provide feedback via an online feedback survey available in 17 languages. NYSED will use this feedback to identify the data most useful to parents and the public to make ongoing improvements to the website.
